Permitting & creation
MassDEP Order of Conditions issued — Wetlands Protection Act file #5-1127; recorded Bk 33797 Pg 168 (Jan 13, 2015). Sets the perpetual conservation conditions on the site.

Planning Board OSRD Site Plan Decision — Beverly Planning Board approves the Open Space Residential Design subdivision (Bk 33792 Pg 502), with the definitive-subdivision approval (Pg 499) and Special Permit #137-14 allowing a fee in lieu of on-site affordable units (Pg 507) — all recorded 1/12/2015. Common land deeded to the HOA; First Amendment recorded — DUC Residential conveys Open Space Parcel C (5.04 ac, 100 Pond View) to the association for $1 (Bk 35266 Pg 472) and, the same day, records the First Amendment to the Trust (Bk 35266 Pg 467): mailbox and mailbox-post maintenance becomes a Trust purpose, with the City bearing no liability for plow/sanding damage. (The amendment surfaced in the 2026-07-17 registry sweep.)

First owner board seated — The Appointment and Acceptance of Successor Trustees are executed, seating the first five-owner board for a two-year term (instruments recorded at the Registry in early 2018).

Buffer-zone permitting done right — NOI → Order of Conditions — A homeowner planning a fenced terraced lawn in the buffer files a Notice of Intent (DEP #5-1341, prepared by Seekamp Environmental; ~600 sq ft of grading, the wetland ~30 ft below the yard). The Commission hears it and issues the Order of Conditions the same evening, 4-0 — and a complete Certificate of Compliance closes the file on an as-built in August 2022. The lane's model example of the buffer-zone process working.

Trustee resignation — #16 — A trustee from #16 resigns from the board; the resignation instrument is recorded at the Registry on November 19, 2021.

After-the-fact filing regularizes completed patio work — Already-completed patio construction and landscaping at a home on the lane come to the Commission by an after-the-fact Request for Determination of Applicability (filed 11/19/2021). At a special meeting the Commission reviews the permeable construction and the 50-foot No-Build line and issues a Negative 3 Determination with conditions, 4-0 — retroactive approval is possible, but it runs through the same review.

The fifth seat is filled — but not on the record — A successor trustee is appointed in 2022 to fill the seat left by the 2021 resignation, but no appointment instrument is recorded at the Registry. The last recorded appointment is from December 2019, so the recorded chain of board changes ends with the November 2021 resignation — the public record currently documents four of the five sitting trustees.

Common-parcel assessment goes to $0 — Beverly's assessed value of the 5-acre common parcel (100 Pond View Lane) drops from $75,600 to $0 beginning FY2023 and holds through FY2026 — the association's annual real-estate tax on the open space ends. The assessor database does not state the mechanism of the change.

Enforcement Order — unpermitted work on the common parcel — After the Conservation Agent identifies an unpermitted stone retaining wall on the intermittent stream bank and a patio in the buffer zone of the HOA's common parcel, the ConCom issues an Enforcement Order requiring an after-the-fact filing.

Negative 3 Determination — 100 Pond View — The ConCom resolves the common-parcel enforcement: the walls, patio, and knotweed management are permitted after the fact, with conditions — including no further alteration of areas under Commission jurisdiction on the parcel.
