6) Requests for Determination of Applicability
b) Cont.: 100 Pond View Lane – after-the-fact application for installation of retaining walls, patio, and
knotweed management – [names redacted]
Michael DeRosa from DeRosa Environmental is present to discuss this Request for a Determination of Applicability (RDA).
DeRosa explains that this after-the-fact RDA application stems from an Enforcement Order issued by the Commission for
unpermitted work performed on the property within the buffer zone to BVW, including installation of a pea stone patio, stone
retaining walls, and knotweed removal. The unpermitted work was performed by the homeowners of 16 Pond View Lane, but
took place on HOA property at 100 Pond View Lane.
DeRosa explains that this proposal includes approval to keep the patio area and to allow for ongoing knotweed management,
as outlined in the knotweed maintenance plan submitted to the Commission. DeRosa shows photographs of the site, including
images of the retaining walls, patio area, and knotweed. DeRosa states that the site has been stabilized and he believes the
homeowner will continue to maintain the property in good shape. DeRosa confirms that the knotweed will be cut and
removed by hand.
The Commissioners discuss the following conditions:
1. There shall be no additional alterations of areas under Conservation Commission jurisdiction without the required
review and permit(s). This condition shall survive in perpetuity.
2. The applicant shall comply with the Long-Term Maintenance Plan for invasive species outlined on page 3 of the
RDA application narrative dated May 27, 2025. This condition shall survive for the life of the Determination of
Applicability. Annual reports on the maintenance plan progress shall be submitted at the end of each growing season.
Charles: Motion to issue a Negative 3 Determination for 100 Pond View Lane, under the Wetlands Protection Act and
the Beverly Wetlands Ordinance, including the special conditions discussed in this meeting. Buchsbaum seconds.
Bertoni takes a roll call vote. Motion carries (5-0).
